This was an action of forcible entry and detainer brought by G. W. Schuster against D. M. Gray, before a justice of the peace of Jefferson county. The action was instituted by the filing of a verified complaint and the issuance and service of a summons. The defendant made a special appearance, and moved the court to quash and set aside the complaint for the reason that the same did not state a causé of action.
