MEMORANDUM AND ORDER

Pending before the Court are Defendant’s Motion for Summary Judgment (Doc. No. 16) and Motion to Strike Plaintiffs Inadmissible Summary Judgment Exhibits. (Doc. No. 23.) For the following reasons, Defendant’s Motion for Summary Judgment must be granted in part and denied in part and Defendant’s Motion to Strike must be granted in part and denied in part.
