The cause was tried at the June term, 1875, of the probate court, resulting in a verdict against plaintiffs in error, who were defendants in that court. Ex*110ceptions taken by plaintiff’s in error to certain rulings of the court, at the trial, were not then drawn up in form, but time 'was allowed for that purpose, extending sixty days from and after the 30th day of June. A motion for new trial was also entered at the same term, but this was not determined until the 10th day of July following, which was one of the days of the July term.
