People v. Lee

Appeal from an order of the County Court of Chemung County (Hayden, J.), entered August 17, 2010, which *1347denied defendant’s motion for resentencing pursuant to CPL 440.46.

Defendant was convicted in 2001 of three counts of criminal sale of a controlled substance in the third degree and one count each of criminal possession of a controlled substance in the third and fourth degrees. He was sentenced as a second felony offender to four prisons terms of 12V2 to 25 years in prison and one term of to 15 years in prison, all to run concurrently.
