This is a matter in contract heard in the Third District Court of Eastern Middlesex in which the plaintiff/respondent seeks recovery for goods sold and delivered. Defendant/petitioner’s defense, as gleaned from his proposed draft report and an affidavit filed with this Division, appears to have been that the party signatory to the documents underlying the claim was without authority to bind the defendant corporation.
