*719Tinsley Stewart, who was a brakeman in the service of the Louisville & Nashville Railroad Company, was killed in a wreck at Gravel Switch, Ky., and this action was brought by his personal representative to recover for his death. On the first trial of the case, there was a verdict and judgment for the plaintiff in the sum of $12,000. The defendant appealed to this court, and, on the appeal, a new trial was ordered. L. & N. R.
