George Billeter, the plaintiff, and foreman for the general contractor on a construction job, had three fingers of his left hand amputated while he was attempting to climb on a cement mixer owned and operated by Rhodes and Jamieson, Ltd., a subcontractor on the same job. Plaintiff brought this action against the subcontractor and its employee, Louis Robbiano, on the theory that he, the plaintiff, was, at the time of the accident, an invitee of the subcontractor, and that the defendants failed to supply him with a safe place in which to work or to warn him of the dangers involved in using the…
