DEWEY, District Judge.

The above-entitled cause came on for hearing in open court at Sioux City, Iowa, on the 6th day of June, 1935, on its merits.

There was presented to the court at that time a motion to transfer this cause of action to equity on the ground that the substituted answer raises equitable issues. By stipulation of the parties, it was agreed that any equitable rights of set-off that may have existed at the time of the closing of the bank might be considered as a full and complete right and defense to this action, whereupon the motion was overruled.
