This suit was filed June 30, 1896, by the appellee, to recover damages from appellant for personal injuries sustained by him on the night of June 17, 1896, while he was engaged in the performance of his duties as brakeman on one of appellant’s freight trains.

He alleged that while in the performance of his duty, using ordinary care for his own safety, he was injured by reason of the pulling out, giving way and breaking of a handhold in a ladder on one of the cars in one of defendant’s trains at the city of Denton, Texas; that said handhold and its fastenings were old…
