Plaintiff in error will be referred to as the defendant as he appeared in the trial court.

He was convicted by a jury in Garfield County of feloniously and unlawfully obtaining the sum of $20.00 from a business establishment in Glen wood Springs “by means and by use of the confidence game.” Motion for new trial was denied and defendant sentenced to a term of not less than eight nor more than fifteen years in the state penitentiary.
