DAVIDSON, Judge.

Appellant was convicted of burglary, his punishment being assessed at two years confinement in the penitentiary.

The alleged owner of the house and property was Joe Patterson. Patterson was the owner of a saloon located on East Ninth Street in Fort Worth, and had been in that business for eight years, and was so engaged in it on the night of the loth of May when this .matter is alleged to have occurred.
