OPINION & ORDER

GWIN, District Judge.

On January 14, 2000, Petitioner Clifford Goodballet (“Goodballet”) filed a petition seeking a writ of habeas corpus. The Court assigned the case to Magistrate Judge William H. Baughman, Jr. for a report and recommendation. On February 19, 2003, Magistrate Judge Baughman issued his report and recommendation. In that report and recommendation, the Magistrate Judge recommended dismissing Go-odballet’s petition because Goodballet did not timely file it. Alternatively, Magistrate Judge Baughman found that Good-ballet’s claim failed on the merits. [Doc. 23.]…
