HERLONG, District Judge.

This matter is before the court with the Report and Recommendation of United States Magistrate Judge William M. Ca-toe, made in accordance with 28 U.S.C. § 636(b)(1)(B) and Local Rule 73.02. 1 Samuel T.D. Lancaster (“Lancaster”) brought a pro se action on February 24, 2005. Magistrate Judge William M.
