A suit for specific performance of an oral contract to devise real estate produced the rulings which require review here. The suit was instituted in the Superior Court of Lincoln County by Betty Simian Barden and her husband, Harris Edward Barden, against Mrs. Irma Abdill, the daughter and sole heir of Harvey E. Dyer, who died intestate. The petition alleged that the plaintiffs and the intestate entered into a contract whereby the plaintiffs were to render certain services to the intestate for the remainder of his life, in return for which the intestate was to devise to them…
