This is an action of tort to recover damages for personal injuries alleged to have been sustained by the plaintiff by reason of the defective condition of a public highway in the city of Boston. At the close of the evidence, the trial judge allowed the defendant’s motion for a directed verdict and reported the case to this court, “being in doubt as to the correctness of . . . [the] ruling in allowing the defendant’s motion for a directed verdict.” (See G. L. [Ter. Ed.] c. 231, § 111.)
