Per Curiam :

This case was referred by the court, pursuant to Pule 45, to Trial Commissioner Lloyd Fletcher for a report of the facts and his recommendation for a conclusion of law. The Trial Commissioner has made his report and recommendation, supported by an opinion, and the case is now before the court on exceptions to the Commissioner’s report, supported by briefs and oral argument.
