PROCTOR, Circuit Judge.

These are cross-appeals from an order of the District Court dismissing the complaint (11268) and allowing a fee to the attorney for plaintiffs (11¿67).

Lois T. Scholia, as next friend for her minor children Paul and Barbara, sued Paul F. Scholia, her divorced husband and father of said children. The complaint revealed the following facts. Mrs. Scholia and the children, Paul and Barbara, resided together in Virginia, and Mr. Scholia, defendant, resided in the District of Columbia.
