—Order unanimously modified on the law and as modified affirmed without costs in accordance with the following Memorandum: Supreme Court erred in denying the motion of Concept Construction Corporation (Concept) for summary judgment based on common-law indemnification. Thomas P. Murray (plaintiff) sustained serious personal injuries while working as a construction foreman for third-party defendant T & T Murray Company, Inc. (T & T).
