GALLAGHER, Chief Justice.
Defendant in error, J. N. Ballard, filed this suit in the district court of Hill county against plaintiff in error, Fire Association of Philadelphia, on an insurance policy issued by it to him on a Ford truck. The parties will be designated as in the trial court. The policy was dated June 24, 1935, and was issued to plaintiff by one of defendant’s agents in Hill county, where plaintiff resided.
