This is an appeal from a judgment in the district court of Orange County in favor of Ada Lee Frederick, appellee, against The Kansas City Southern Railway Company, appellant.

The appellee, Ada Lee Frederick, brought this suit against The Kansas City Southern Railway Company, seeking to recover damages alleged to have resulted when a train owned and operated by appellant struck her vehicle.
