The appellant was indicted for the offense of robbery alleged to have been committed on one John C. Murray on the sixth day of March, 1904. The indictment charged that the defendant ‘£ did then and there willfully, unlawfully, feloniously, and forcibly take from the person of one John C. Murray one gold coin ... of the denomination of five dollars.” After arraignment and plea of not guilty, the case was tried to a jury, which returned a verdict of guilty.
