INTRODUCTION

More than one hundred habeas corpus petitions are currently pending in the Western District of Washington wherein aliens ordered deported to countries that have refused them admittance challenge the legality of their continued detention by the Immigration and Naturalization Service (INS). In an order dated April 22, 1999, the undersigned judges of the Western District designated five lead cases 1 that present issues common to all petitioners and directed the parties to brief and argue these common issues together; the remaining cases were stayed…
