Action for breaches of contract, between plaintiff and defendant, of date June 17, 1897, by which, as alleged, “said defendant agreed to receive from said plaintiff at the town of Colusa .... certain fruit, to wit, prunes, and to dry, cure, pack, carefully handle, and market the same in the most approved manner, for the account of the said plaintiff, for the compensation in said contract provided, and by which said contract said plaintiff agreed to pay to said defendant the certain compensation for said services in said contract specified.”
