This action is brought by copartners, doing business under the firm name of the Farm and Sea Food Shops, to recover for damage to an automobile truck, resulting from a collision on September 20, 1922, with one of the defendant’s cars.

The record shows that at the time of the accident the truck and the merchandise in it were owned by the partnership, and that the bills for repairs after the accident were made to the Farm and Sea Food Shops.
