(After stating the case).' The applicants ■have complied on their part with every thing required by law, and now demand their patent agreeably to the certificate and survéy returned, by the commissioners. To this several objec.tions are made on behalf of the commonwealth. It is said that the.first certificate is void, because Thomas Cooper was not a ■commissioner at the. time he signed it-, and that the second is void, because Alexander Scott being interested, could not lawfully act as a commissioner.
