This is an appeal from a judgment of the Appellate Court for the Third District which affirmed an order of the circuit court of La Salle County dismissing a post-conviction petition (Ill. Rev. Stat. 1971, ch. 38, par. 122 — 1 et seq.) filed by defendant, Dale Grammer. Defendant’s conviction resulted from a plea of guilty to a charge of aggravated incest for which he was sentenced to a term of 2 to 10 years in the penitentiary.
