Appeal from Special Term, Westchester County. Action by Alexander Rutkowski and another against the Susquehanna Qoal Company, impleaded with the Pennsylvania Railroad Company. From an order vacating an attempted service of a summons upon defendant Coal Company’s alleged managing agent, plaintiffs appeal.
