The plaintiff, a tenant in a building of the defendant, his landlord, located in Torrington, in the Waterbury defense area, brought this action to the Court of Common Pleas, seeking to recover damages on the ground that the defendant had demanded and received rent from him for several months in an amount in excess of the maximum fixed by the regulations of the federal Office of Price Administration under the provisions of the Emergency Price Control Act of 1942. 56 Stat. at Large, Chap. 26, p. 23; 50 U.
