The bill of complaint in this case was filed in Circuit Oourt No. 2 of Baltimore City on the 13th of July, 1920, by The "Fisher & Carozza Brothers Company, a corporation “engaged in general contracting and road and bridge building,” against John N. Mackall, Omar D. Orothers and C. D. Weinbrenner, constituting the State Roads Commission, and the McLean Contracting Company, a corporation engaged in the contracting business.
