Robert David Martin, appeals the district court’s denial of his petition for a writ of habeas corpus filed pursuant to 28 U.S.C.A. § 2254 (West 1977). We reverse the judg ment of the district court and remand the action for an evidentiary hearing.

FACTS

On November 3, 1980, Jerry Whidby, an investigator for the Sheriffs Office, Putnam County, Georgia, approached Robert David Martin at Martin’s place of employment and attempted to question him about a burglary.
