This cause is in this court upon appeal on questions of law and fact from the judgment of the Common Pleas Court of Belmont county.

In his petition filed in the Court of Common Pleas, Homer B. Lichtenberger, plaintiff, alleges that he is the owner in fee simple of certain specifically described real estate situate in the town of St. Clairsville, Belmont county, Ohio; that he acquired his interest as remainderman under the will of H.
