This second degree murder trial originated from events which occurred on September 20, 1993, after which a grand jury indicted Mr. Gobert for second degree murder on November 18, 1993. A twelve-*617member jury found him to be guilty as charged, and the trial court sentenced him to life imprisonment without benefit of parole, probation, or suspension of sentence. However, it later ordered a new trial pursuant to Mr. Gobert’s 1998 application for post-conviction relief.
