CARTER, Judge.

This is an appeal from a judgment rendered by the Secretary of the Louisiana Department of Environmental Quality (DEQ), assessing a penalty for violations of the Environmental Quality Act, Louisiana Water Control Law.

FACTS

AMCO Construction Company (AMCO) owns and operates a ready-mix concrete plant bn Louisiana Highway 30, approximately one-half mile west of Interstate 10, near Gonzales. On two separate occasions, once on November 10, 1981, and again on June 6, 1985, the Department of Environmental Quality (DEQ) issued a Compliance Order to AMCO, for violations of LSA-R.S.…
