This is an action for deceit in the sale of real estate. There was evidence that statements by the defendant in regard to the rents received by him were false. He denied that he made the statements.

The plaintiff offered to show that, about six months before the trial, the defendant said to the witness, who had acted as agent in the negotiations, “I will give you a thousand dollars if you settle the case.” The defendant objected on the ground that it was not an admission and was irrelevant. The judge stated: “Well, it is an expression of opinion on the part of the defendant that he is liable”…
