Tompkins, Judge.

On the 14th day of April, 1868, Francis M. Long executed a mortgage to the Ocmulgee .Building and Loan Association, of Macon, Georgia, upon certain lots of land in that city, as a security for the páyment of a sum of money due by Long to the association. In 1872, this mortgage had been foreclosed and fieri facias issued. In December, 1869, a homestead was set apart, at the instance of the wife of Long, upon the land so mortgaged to the Loan Association.
