OPINION OF THE COURT
FLAHERTY, Justice.
This is an appeal, by allowance, from a memorandum opinion and order of the Superior Court which affirmed an order of the Court of Common Pleas of Wyoming County dismissing criminal charges which had been lodged against James Joel Turrell, the appellee herein 391 Pa.Super. 642, 563 A.2d 195. The charges consisted of three counts of “theft by failure to make required disposition of funds received,” 18 Pa.C.S. § 3927(a), and arose from Turrell’s misuse of funds from an escrow account while he was engaged in the practice of law.
