Rodey, Judge,

delivered the following opinion:

The plaintiffs in this case allege that they are citizens of, and residents in, Porto Rico, and that the defendants are subjects of the King of Spain and reside in that country. The suit is an action for damages in the sum of about $72,000, alleged to have occurred during certain foreclosure and receivership proceedings, while defendants were residents of Porto Rico, some years ago. The proceeding was commenced by the issuance of a summons in the ordinary form, and the contemporaneous issuance of a writ of attachment. The marshal’s return shows…
