Faville, J. —

The accident in question occurred about one o’clock in the afternoon on the 26th day of October, 1921. Ap.pellee at that time was a boy about eight years of age, and was on his way to school. The accident occurred near the intersection of Central Avenue and Fifteenth Street, in the city of Dubuque. Central Avenue extends north and south, and is intersected by Fifteenth Street at right angles.
