Plaintiff, a railroad employee, filed a lawsuit against his employer, the defendant railroad, to recover damages for (1) personal injuries suffered from his working conditions, in violation of the Federal Employers’ Liability Act (FELA), 45 U.S.C. § 51 et seq.; and (2) for personal injuries caused by the use of locomotives in improper condition, in violation of the Locomotive Inspection Act (LIA), 49 U.S.C. §§ 20701-20703.1 At the conclusion of plaintiffs case, the trial court entered a directed verdict in defendant’s favor on the LIA count.
