RODRIGUEZ, District Judge:
This is an appeal from an order of the United States District Court for the Eastern District of Pennsylvania which granted summary judgment to the Secretary of Health and Human Services (“the Secretary”). This court has jurisdiction under 28 U.S.C. § 1291 (1982) to review the decision of the district court. The question presented by this appeal is whether, pursuant to an order of the district court remanding a case to the Secretary for a further hearing, the Secretary is empowered to examine issues other than those that were actually raised by the…
