GRUENDER, Circuit Judge.
Michael Fiorito pleaded guilty to one count of mail fraud. While awaiting sentencing and against the advice of counsel, Fiorito filed several letters requesting to withdraw his guilty plea. The district court 1 granted Fiorito’s request and re: leased him from the plea agreement. Fiorito proceeded to trial and was convicted.
