Sudolnik, J.), rendered November 1, 2001, convicting defendant, after a jury trial, of robbery in the first degree and resisting arrest, and sentencing him to concurrent terms of 12 years and one year, respectively, and order, same court and Justice, entered on or about April 2, 2004, which denied defendant’s CPL 440.10 motion to vacate the judgment, unanimously affirmed.
