This is an appeal from a judgment in two consolidated actions.

The facts as found by the court below are as follows: On or about April 15, 1957, Gladys L. Spurgeon [hereafter referred to as respondent], and Jack Buchter [hereafter referred to as appellant], an architect, entered into an oral agreement on the following terms: the appellant was to design and prepare plans for the construction of an apartment building on respondent’s property at the end of View Street in the city of Oakland, County of Alameda, State of California; the total cost of the building, including the architect’s fees,…
