—In a proceeding pursuant to CPLR article 78 to review a determination of the New York State Division of Housing and Community Renewal, dated May 16, 1996, which affirmed an order of the Rent Administrator, dated March 20, 1990, finding the existence of a willful rent overcharge and imposing a penalty of treble damages, the New York State Division of Housing and Community Renewal appeals from an order of the Supreme Court, Kings County (Barasch, J.), dated January 14, 1997, which remitted the matter to the DHCR for reconsideration of certain factual issues.
