This cause came on for consideration upon a petition for Writ of Habeas Cor*593pus filed by Robert Hernandez, pro se, in forma pauperis. By order of September 18, 1968, this Court held that the petitioner had exhausted available state remedies in satisfaction of the requirements of § 2254, Title 28, United States Code.
