I. INTRODUCTION

This matter came on for trial before the Court on December 2, 1996. Defendant had previously filed a Motion for Summary Judgment (Doc. Num. 46), which the Court withheld ruling on until such time as the evidence was presented at trial. At the conclusion of plaintiffs case, the Court dismissed plaintiffs employment discrimination claim against the defendant because the evidence failed to establish a prima facie case.
