The court below sustained a general demurrer to the suit of plaintiff below, appellant in this court, from which this appeal is taken. The suit was brought in the District Court, of McLennan County by W. T. Fenton and D. T. Bomar against appellee, the Farmers and Merchants National Bank. The petition shows that on the 3d day of March, 1899, the defendant bank recovered judgment in the District Court of McLennan County against plaintiff Fenton, Joshua A. Graham, and Mrs. Lucretia Schuster for three-fourths undivided interest in certain lands in Sterling County, upon…
