The plaintiff alleges that, in the month of April, 1841, he obtained a judgment in the District Court of St. Mary against Benjamin M. Mayes, one of the present defendants, for $7869, 74, with interest and costs. That on the 28th. of April, an execution was issued on said judgment, and, by the sheriff *21of the parish, levied on a number of slaves, which were duly-advertised for sale in the month of June, 1S41.
