Smith, Judge Hooked Group, LLC, whom we will refer to as the Landowner, owns a property zoned for commercial use in the City of Chesapeake. Previously, the property was accessible from two roads, but in 2017 the City closed one of them to all but emergency vehicles. The Landowner filed a declaratory judgment action, claiming that the closure constituted a taking that entitled it to compensation.…
