MEMORANDUM AND ORDER

MAGNUSON, District Judge.

This matter is before the court upon plaintiffs’ motion for a preliminary injunction. For the reasons stated below, the court grants plaintiffs’ motion in part and denies plaintiffs’ motion in part.

BACKGROUND

The Lower Sioux Indian Community of Minnesota (Community) is a federally recognized tribe of American Indians. The Community was organized in 1936, pursuant to the Indian Reorganization Act of 1934, 25 U.S.C. §§ 461-479. The Community established Jackpot Junction Casino in 1984.
